These Terms and Conditions govern your use of the Write My Song website and services. By placing an order, accessing our website, or purchasing a personalised song, you agree to be bound by these Terms.

1. About Write My Song

Write My Song is an Australian owned and operated business providing personalised, custom-written digital songs created based on information supplied by customers.

2. Our Services

Write My Song creates custom digital music products based on the details provided by the customer. Each song is uniquely written and produced and delivered electronically via email.

All products are made to order and tailored specifically to individual requests.

3. Orders and Information Provided

By placing an order, you confirm that:

  • all information you provide is accurate to the best of your knowledge;

  • you have permission to include any personal details about third parties;

  • you understand the final song is created using the information you supply.

Write My Song is not responsible for inaccuracies resulting from incorrect or incomplete information provided by the customer.

4. Turnaround Time

We aim to deliver your personalised song within 72 hours from the time payment is received and all required information has been submitted.

While we make every effort to meet this timeframe, delays may occur due to:

  • incomplete or missing customer information;

  • high demand or seasonal order volumes;

  • technical or production-related issues beyond our control.

If a delay occurs, we will notify you as soon as reasonably possible.

5. Revisions

Each order includes up to three (3) free revisions, provided the requested changes are consistent with the original information supplied.

Revisions do not include complete rewrites or changes that significantly alter the original song direction unless otherwise agreed.

6. Digital Delivery

All songs are delivered electronically via email.
No physical items will be shipped.

Customers are responsible for ensuring that the email address provided is correct and accessible.

7. Usage Rights

Upon delivery, you are granted the right to:

  • share your song publicly;

  • post or perform your song;

  • use your song for personal or promotional purposes.

Write My Song retains the right to reference anonymised or sample versions of songs for marketing purposes unless you request otherwise in writing.

8. Refunds and Cancellations

Due to the personalised nature of our products:

  • refunds are not available once work has commenced;

  • cancellations may only be accepted prior to songwriting beginning.

This policy is in accordance with the Australian Consumer Law for customised digital goods.

If there is an issue with your order, please contact us and we will work with you to resolve it fairly.

9. Intellectual Property

All original compositions are created by Write My Song.
Upon full payment, customers are granted usage rights as outlined above.

Write My Song retains ownership of underlying composition rights unless otherwise agreed in writing.

10. Privacy

Personal information collected is handled in accordance with our Privacy Policy and Australian privacy legislation.

We take reasonable steps to protect your information and use it only for the purpose of fulfilling your order.

11. Limitation of Liability

To the maximum extent permitted by law, Write My Song is not liable for:

  • indirect or consequential loss;

  • emotional expectations not met due to subjective preferences;

  • delays caused by circumstances beyond our reasonable control.

Nothing in these Terms limits your rights under Australian Consumer Law.

12. Changes to Terms

Write My Song may update these Terms from time to time. Updated versions will be published on our website and apply to all future orders.

13. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia, and any disputes shall be subject to the jurisdiction of Australian courts.
